Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of DriveSarathi (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

DriveSarathi is software that helps driving schools manage students, class scheduling, fees, attendance, RTO / licence tracking and student logins. We may add, change or remove features over time to improve the Service.

• You must provide accurate account information and keep your login credentials secure.
• You are responsible for all activity under your account, including that of your staff and drivers.
• By creating a school account you confirm you are authorised to act for that driving school and are at least 18 years old.

DriveSarathi is offered on a subscription basis. A free trial may be available (its duration is shown at signup). After the trial, continued use requires an active paid plan.

• Subscription fees are billed in advance for each billing period.
• Fees, billing cycle and plan details are shown in the app and at signup. Applicable taxes may be added.
• You may cancel at any time; cancellation only stops future renewals.
• The current billing period is non-refundable, except where a refund is required by applicable law. If your plan lapses, access may be paused until it is renewed.

You (the driving school) own and are responsible for the data you enter, including student information. You represent that you have the right and any necessary consent to collect and use that data through DriveSarathi.

• Ensure student details are accurate and used only for legitimate school purposes.
• A student's Aadhaar number is optional and entered only by you (the school). It is stored securely using encryption. You are responsible for obtaining all required consent and complying with applicable law.
• Do not upload unlawful content or data you are not permitted to share.

You agree not to:

• Use the Service unlawfully, or to send spam or harassing messages.
• Attempt to access another school's data, or breach or probe our security.
• Copy, resell, reverse-engineer or overload the Service.
• Use the Service to violate anyone's privacy or rights.

DriveSarathi, its software, design and branding are owned by us and protected by law. You get a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. Your data remains yours.

You may not copy, reproduce, distribute, modify, resell or reverse engineer the Service, or use the DriveSarathi name, logo or branding, without our prior written permission.

The Service relies on trusted third-party providers (for example WhatsApp/Meta for messaging, and infrastructure and hosting providers). Their availability is outside our control, and messaging via WhatsApp is subject to WhatsApp's own terms. We are not responsible for third-party outages or changes.

We aim to keep DriveSarathi available and reliable, but the Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, and reminders or messages may occasionally be delayed or fail to send.

To the maximum extent permitted by law, DriveSarathi is not liable for any indirect, incidental or consequential loss (including lost data, revenue or bookings). Our total liability for any claim is limited to the amount you paid us for the Service in the three (3) months before the claim.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or misuse the Service. We may also discontinue the Service with reasonable notice.

On account closure you may request an export of your data. We delete the associated data within 30 days of a valid deletion request or account closure, unless retention is required by law.

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and material changes will be communicated through the Service. Continued use after an update means you accept the revised Terms.

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Gujarat, India.
